Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and SMAZENKA LABS LLC (“we,” “our,” or “the Company”) governing your use of the Namagatsa application and website (“the App”). By creating an account or using the App, you accept these Terms and our Privacy Policy. If you do not agree, do not use the App.

The App is intended for users aged 13 and older. By using the App, you confirm that you are at least 13 years old and legally capable of agreeing to these Terms. If you are under the age of majority in your jurisdiction, you may use the App only with the consent of a parent or legal guardian.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Provide accurate information when signing up and keep it up to date. Notify us promptly at support@smazenka.com if you suspect unauthorized use of your account.

The App offers a free tier and paid premium features. Payments are handled through the applicable purchase platform. Subscription fees are billed in advance and renew automatically based on your selected plan until cancelled. You may cancel at any time through the purchase platform you used; cancellation takes effect at the end of the current billing period. Refunds for partial periods are subject to that platform’s guidelines, which may take precedence.

Namagatsa’s AI coaching offers motivational and organizational guidance for habit building. It is not medical, psychological, therapeutic, financial, or other professional advice, and it is not a substitute for consultation with a qualified professional. Always use your own judgment, and consult a professional before making changes related to your health or well-being.

You agree not to:

• Use the App for illegal purposes.
• Attempt to access other users’ data or interfere with the App’s security features.
• Hack, reverse-engineer, or disrupt the App.
• Abuse the AI coaching features, including attempts to generate harmful or unlawful content.
• Provide false information during sign-up.

By using the App, you consent to anonymous analytics collection as detailed in our Privacy Policy.

All App content — including text, designs, logos, coaching content, and underlying technology — is owned by SMAZENKA LABS LLC and protected by copyright, trademark, and other intellectual property laws. You retain ownership of any user-generated content (“UGC”) you create in the App, such as habit names and notes. By submitting UGC, you grant SMAZENKA LABS LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, and modify your UGC solely for the purpose of operating and improving the App. We will not share your UGC with others without your consent.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. SMAZENKA LABS LLC IS NOT RESPONSIBLE FOR ANY HARM, INJURY, OR DAMAGES RESULTING FROM YOUR USE OF THE APP OR FROM FOLLOWING ITS SUGGESTIONS, INSIGHTS, OR COACHING. ALL RISKS ASSOCIATED WITH YOUR ACTIONS, INCLUDING PHYSICAL, EMOTIONAL, OR LEGAL CONSEQUENCES, ARE SOLELY YOURS TO BEAR. You are responsible for ensuring that the habits and activities you pursue are safe and appropriate for you, using your own judgment.

SMAZENKA LABS LLC may suspend or terminate your access to the App without notice if you violate these Terms or engage in conduct harmful to the App, its users, or third parties. You may stop using the App and deactivate your account at any time; it is permanently deleted after a 30-day deletion window — see our account deletion instructions.

These Terms are governed by the laws of the State of New Jersey and the United States of America, as SMAZENKA LABS LLC is a US-based company, excluding conflict of law provisions.

We may revise these Terms periodically. Significant updates will be communicated via the App or email (if provided). Continued use of the App after changes take effect signifies your acceptance.
