This Privacy Policy governs the Namagatsa application and website (“the App”), an offline-first habit-formation platform with elastic goals and AI coaching. It outlines how SMAZENKA LABS LLC (“we,” “our,” or “the Company”) collects, uses, stores, and protects your personal information. By using the App, you consent to the practices described herein.
Information We Collect
To provide and personalize the App, we collect:
- Waitlist information: your email address when you request an invitation.
- Account information: your email address and authentication identifiers if you are invited to create an account.
- Habit data: the habits you create, their type and target levels (Mini, Plus, Elite), completions and skips, streaks, notes, and the reasons you optionally provide when a habit is missed.
- AI coaching conversations: messages you exchange with the in-app AI coach and the habit context needed to answer them.
- Device and technical information: device type, operating system, app version, and push-notification subscription details (only if you enable reminders).
- Usage analytics: anonymous usage, performance, and stability metrics that help us improve the App.
How We Use Your Information
Your data is used to:
- Contact you about your waitlist request or an available invitation.
- Sync your habits and progress across your devices and keep the App working offline.
- Personalize coaching, insights, and habit suggestions based on your goals and check-in history.
- Send habit reminders and notifications you have opted into.
- Process payments and manage subscriptions through the respective purchase platform.
- Improve the App’s functionality and user experience.
- Send product updates or offers (only if you opt in).
AI Features
Namagatsa’s coaching features use carefully selected processing services. When you use AI coaching, your messages and the minimum habit context required to generate a useful response are processed under contractual confidentiality terms. Your data is not used to train these systems, and we never send more than the feature requires. AI coaching is guidance for habit building — it is not medical, psychological, or professional advice.
Offline Storage and Sync
Namagatsa is offline-first: your habit data is stored locally on your device so the App works without a connection, and it is synchronized with our servers when you are online. Removing the App from your device deletes the local copy; the synced copy remains in your account until you delete it or your account.
Service Providers
We work with a limited set of service providers to operate the App:
- Hosting and account services — to operate, secure, and maintain the App (with servers located in the United States).
- AI processing services — processing of coaching conversations as described in Section 4.
- Payment and subscription services — purchase and subscription handling. We never receive your full payment card details.
- Analytics and reliability services — anonymous usage data to improve your experience. No personal information is sold or shared for advertising.
Data Sharing
We do not sell your personal information. We do not share it with third parties except:
- With the service providers listed above, under strict confidentiality terms and only to operate the App.
- As required by law or to protect the App, its users, or the public.
We do not sell personal information as defined under the CCPA. California residents may contact support@smazenka.com to exercise their rights, and we will not discriminate against you for doing so.
Data Storage and Security
Your data is stored on your device and on our servers located in the United States. If you are located outside the United States, your data will be transferred to and stored in the United States; by using the App you consent to this transfer. We employ industry-standard measures such as encryption in transit and at rest, row-level access controls, and secure storage. However, no online transmission or storage system is entirely secure, and we cannot guarantee absolute protection.
Your Rights
You may at any time:
- Access, update, or correct your personal information.
- Request a copy (export) of your data by contacting support@smazenka.com.
- Request deletion of your account and data — see our account deletion instructions. A deletion request deactivates your account and signs you out immediately. Your account and personal information are permanently deleted after a 30-day deletion window, except data we must retain for legal or regulatory purposes.
- Opt out of promotional communications at any time in the App or by contacting us.
Age Restriction
The App is intended for users aged 13 and above. We do not knowingly collect data from children under 13. If such data is detected, we will promptly delete it. If you believe a child under 13 has provided us personal information, please contact support@smazenka.com.
Changes to This Policy
We may revise this Privacy Policy periodically. Significant updates will be communicated via the App or email (if provided). Continued use of the App after changes take effect signifies your acceptance.
